HB 5341 FATE (Fair Access to Employment Bill)

HB 5341 is the F.A.T.E. (Fair Access to Employment) bill sponsored by Rep. Jehan Gordon-Booth and Sen. Don Harmon.

Currently, petitions to seal criminal records are being denied because of outstanding fees and fines that petitioners cannot afford to pay. HB 5341 clarifies that fines and fees cannot be considered when determining whether a person can seal their record.

HB 5341 SIGNED INTO LAW by Governor Bruce Rauner on August 10, 2018 and is now Public Act 100-776. HB 5341 passed the Illinois House on May 24 by a vote 63-39. It passed the Illinois Senate on May 30 by a vote 32-21-1.
